Terms of Service

These Terms of Service govern your access to and use of WalchandPRO, the online learning and certification platform operated by Walchand College of Engineering, Sangli.

By accessing or using the Platform, or by purchasing any course or service on the Platform, you (“Learner” or “User”) agree to be bound by these Terms of Service (“Terms”). If you do not agree with all of these Terms, you must discontinue use of the Platform immediately.

1. About WalchandPRO

WalchandPRO is an online education and certification platform (“Platform”) owned and operated by Walchand College of Engineering, Sangli (“WCE”), a Government-Aided Autonomous Institute affiliated to Shivaji University, Kolhapur, having its registered office at Vishrambag, Sangli – 416 415, Maharashtra, India.

WalchandPRO offers online certificate courses, skill training programmes, and professional development content to students, graduates, and working professionals. The Platform is accessible at https://walchandpro.in and through associated mobile applications.

We reserve the right to make changes to these Terms at any time. We will update the “Last Updated” date at the top of this page when changes are made. It is your responsibility to review these Terms periodically.

All users who are minors (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Platform.

2. Definitions

  • “Platform” means the WalchandPRO website, mobile application, and all associated digital infrastructure.
  • “Course” means any paid or free online course, certification programme, MOOC, or training content available on the Platform.
  • “Learner” means any registered individual who accesses or purchases content on the Platform.
  • “WCE” means Walchand College of Engineering, Sangli, the entity operating the Platform.
  • “Content” means all videos, text, assessments, quizzes, assignments, code, graphics, and any other learning or platform material available on the Platform.
  • “Contributions” means any content, reviews, comments, posts, or other material submitted by a Learner on the Platform.
  • “Certificate” means the digital or physical certificate of completion issued by WCE upon a Learner’s successful completion of a Course.

3. Our Services

The Platform is intended for use by persons in India. Those who access the Platform from outside India do so on their own initiative and are solely responsible for compliance with applicable local laws. WCE makes no representation that the Platform or its content is appropriate or available for use in all locations.

4. Eligibility and User Representations

To register and use the Platform, you represent and warrant that you:

  • Are at least 18 years of age, or have the consent of a parent or legal guardian if below 18.
  • Are capable of entering into a legally binding agreement under Indian law.
  • Are not barred from receiving services under applicable Indian law.
  • Will provide accurate, complete, and current registration information and keep it updated.
  • Will not access the Platform through automated or non-human means, bots, or scripts.
  • Will not use the Platform for any illegal or unauthorised purpose.
  • Will comply with all applicable laws and regulations in your use of the Platform.

If you provide information that is untrue, inaccurate, or incomplete, WCE has the right to suspend or terminate your account and refuse current or future use of the Platform.

5. Account Registration

You must create an account to access paid courses on the Platform. You agree to keep your password confidential and are responsible for all activity that occurs under your account. You must notify WCE immediately at walchandpro@walchandsangli.ac.in if you suspect unauthorised access to your account.

WCE shall not be liable for any loss arising from your failure to protect your account credentials. You may not share your account or allow others to access the Platform using your credentials. WCE reserves the right to remove or change a username that is, in WCE’s sole discretion, inappropriate, obscene, or otherwise objectionable.

6. Courses and Enrolment

6.1 Course Availability

WCE reserves the right to modify, reschedule, or cancel any course at any time. In the event of cancellation by WCE, enrolled learners will be notified and refunds processed as per the Refund and Cancellation Policy.

6.2 Cohort-Based Courses

Certain courses are offered in fixed batches with set start dates, live sessions, and submission deadlines. Learners in cohort-based courses are expected to adhere to the published schedule. Missing live sessions does not entitle the Learner to a refund or extension. Recorded replays, where available, are treated as equivalent to live access.

6.3 Self-Paced Courses

Self-paced courses may be accessed at any time within the validity period specified on the course page. WCE does not guarantee indefinite access and may archive or retire course content with reasonable notice to enrolled learners.

6.4 Prerequisites

Some courses require prior knowledge or qualifications as listed on the course page. WCE is not responsible if a Learner purchases a course without meeting the stated prerequisites.

6.5 Course Completion and Certificates

Certificates are issued only upon meeting all completion criteria, including minimum assessment scores, attendance requirements for live sessions where applicable, and submission of required assignments. Certificates issued by WCE through WalchandPRO are certificates of completion of training programmes. They are not academic degrees or university qualifications. WCE makes no representation that certificates will be recognised by any employer, government body, or other institution, though WCE will make reasonable efforts to ensure industry relevance of its programmes. Certificates will be revoked if a Learner is found to have obtained them through fraudulent means, including cheating in assessments, sharing answers, or misrepresenting identity.

7. Payments

7.1 Pricing

All course fees are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. WCE reserves the right to change course prices at any time. Price changes will not affect purchases already completed. WCE reserves the right to correct any errors or mistakes in pricing, even if payment has already been received, and reserves the right to refuse any order placed through the Platform.

7.2 Accepted Payment Methods

The Platform accepts the following forms of payment: Visa, Mastercard, UPI, Razorpay, net banking, and any other methods made available through WCE’s authorised payment gateway partners from time to time. All payment transactions are processed by third-party payment gateways and are subject to their respective terms and conditions.

7.3 Payment Security

WCE does not store your card or bank account details. All payment information is handled directly by the payment gateway in a PCI-DSS compliant environment. WCE is not liable for any loss or damage arising from payment gateway failures or security breaches on the gateway’s side.

7.4 Order Confirmation

A purchase is confirmed only when you receive a written confirmation email with an order ID. If payment is debited but no confirmation is received, contact walchandpro@walchandsangli.ac.in within 48 hours with your transaction reference number.

7.5 GST and Taxes

Applicable Goods and Services Tax (GST) will be charged on all paid courses as per prevailing Indian tax law. A GST invoice will be issued upon request. Learners requiring a GST invoice must provide their GSTIN at the time of purchase.

7.6 EMI and Instalment Payments

Where EMI or instalment options are offered, they are facilitated through third-party financial partners. WCE is not responsible for the terms, interest charges, or processing fees levied by such partners. Refunds on EMI purchases are governed by the Refund Policy.

8. Refund and Cancellation

Refunds are governed by the WalchandPRO Refund and Cancellation Policy, which forms an integral part of these Terms and is available at https://walchandpro.in/refund-policy. Key provisions:

  • Full refund if requested within 24 hours of purchase with no content accessed.
  • 75% refund if requested within 7 days with 20% or less content accessed.
  • No refund after 7 days or if more than 20% of content has been accessed.
  • Full refund if WCE cancels a course before commencement.
  • Pro-rata refund if WCE cancels a course after commencement.
  • GST will not be refunded if already paid or processed.

All refund requests must be submitted to walchandpro@walchandsangli.ac.in with the order ID and relevant details.

9. Intellectual Property Rights

WCE is the owner or licensee of all intellectual property rights in the Platform, including all source code, databases, functionality, software, website designs, audio, video, text, graphics, assessments, and trademarks (“Content” and “Marks”). All Content and Marks are protected under Indian and international copyright and trademark law.

Subject to your compliance with these Terms, WCE grants you a limited, non-exclusive, non-transferable, revocable licence to access the Platform and course content solely for your personal, non-commercial learning purposes.

You must not copy, reproduce, aggregate, republish, upload, post, publicly display, encode, translate, transmit, distribute, sell, license, record, screenshot, or otherwise exploit any Content or Marks for any commercial purpose without WCE’s prior written permission. You must not use any automated tools, bots, or scrapers to access or download Platform content.

Your Submissions: By sending WCE any question, comment, suggestion, idea, or feedback about the Platform (“Submissions”), you agree to assign all intellectual property rights in such Submission to WCE. WCE shall own such Submissions and may use them for any lawful purpose without acknowledgement or compensation to you.

10. User-Generated Contributions

The Platform may allow Learners to post reviews, comments, discussion board posts, or other content (“Contributions”). When you create or submit any Contribution, you represent and warrant that:

  • Your Contribution does not infringe the intellectual property, privacy, or other rights of any third party.
  • You are the creator or have all necessary rights and permissions to submit the Contribution.
  • Your Contribution is not false, misleading, defamatory, obscene, harassing, discriminatory, or otherwise objectionable.
  • Your Contribution does not violate any applicable law or regulation.
  • Your Contribution does not contain unsolicited advertising, spam, or promotional material.
  • Your Contribution does not include offensive references to race, national origin, gender, sexual preference, or physical condition.

You retain ownership of your Contributions. By submitting a Contribution, you grant WCE a non-exclusive, royalty-free licence to use, display, and distribute it on the Platform. WCE is not liable for any statements or representations in your Contributions, you are solely responsible for them.

11. Reviews and Ratings

Where the Platform allows Learners to post course reviews or ratings, you agree to: post only reviews based on your own first-hand experience with the course; not use offensive, abusive, or discriminatory language; not post false or misleading statements; not organise coordinated review campaigns; and not post reviews if you have a competing commercial interest.

WCE may accept, reject, or remove reviews at its sole discretion. Reviews do not necessarily represent the views of WCE.

12. Prohibited Activities

You may not use the Platform for any purpose other than its intended educational use. You agree not to:

  • Systematically retrieve data or content from the Platform to build a database or directory without written permission.
  • Trick, defraud, or mislead WCE or other users, including attempting to obtain sensitive account information.
  • Circumvent, disable, or interfere with security-related features of the Platform.
  • Upload or transmit viruses, malware, Trojan horses, or other harmful code.
  • Engage in any automated use of the Platform, including scripts, bots, or data mining tools.
  • Attempt to impersonate another user or person.
  • Use another user’s account or credentials.
  • Interfere with or disrupt the Platform or its connected networks.
  • Harass, threaten, or abuse WCE staff, faculty, or other users.
  • Attempt to reverse-engineer, decompile, or copy the Platform’s software or code.
  • Delete or alter any copyright or proprietary rights notices on the Platform.
  • Use the Platform to compete with WCE or for any revenue-generating commercial enterprise.
  • Share course access credentials with any other person.
  • Post content that disparages, tarnishes, or harms WCE or the Platform.

WCE reserves the right to suspend or permanently terminate the account of any Learner found in violation of these provisions, without refund, and to take appropriate legal action.

13. Platform Management

WCE reserves the right to: monitor the Platform for violations of these Terms; take appropriate legal action against violators; restrict, suspend, or disable access to any part of the Platform or any user’s account; remove content that is excessive in size or harmful to Platform systems; and otherwise manage the Platform to protect WCE’s rights and ensure proper functioning.

14. Privacy Policy

WCE collects and processes personal data in accordance with its Privacy Policy available at https://walchandpro.in/privacy, which is incorporated into these Terms by reference. By using the Platform, you consent to such collection and processing. The Platform is hosted in India. If you access it from outside India, you consent to your data being transferred to and processed in India. WCE will not sell your personal data to third parties.

15. Term and Termination

These Terms remain in effect while you use the Platform. WCE reserves the right to deny access, suspend, or terminate your account at any time, with or without notice, for breach of these Terms, fraudulent activity, or as required by law.

If your account is terminated, you are prohibited from registering a new account under your name, a fake name, or any third party’s name without WCE’s consent. Upon termination, your licence to access course content ceases immediately. WCE reserves the right to pursue civil, criminal, or injunctive remedies as appropriate.

You may request deletion of your account at any time by contacting walchandpro@walchandsangli.ac.in. Account deletion does not entitle you to a refund.

16. Modifications and Service Interruptions

WCE reserves the right to change, modify, or remove content from the Platform at any time without notice. WCE will not be liable for any modification, price change, suspension, or discontinuance of the Platform or its content.

WCE does not guarantee that the Platform will be available at all times. Scheduled or unscheduled maintenance, hardware or software issues, or other factors may cause interruptions or errors. Nothing in these Terms obligates WCE to maintain the Platform or provide corrections, updates, or releases on any particular schedule.

17. Corrections

WCE reserves the right to correct any typographical errors, inaccuracies, or omissions in course descriptions, pricing, availability, or other information on the Platform at any time and without prior notice.

18. Disclaimer of Warranty

The Platform and all content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, WCE disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. WCE makes no warranties regarding the accuracy or completeness of course content, uninterrupted access, or freedom from viruses or harmful components. Outcomes from completing a course, including employment, salary, or career results, depend on the Learner’s own effort, ability, and market conditions, which are beyond WCE’s control.

19. Limitation of Liability

To the fullest extent permitted by applicable Indian law, WCE’s total liability to any Learner for any claim arising under these Terms shall not exceed the amount paid by that Learner for the specific course giving rise to the claim. WCE shall not be liable for any indirect, incidental, consequential, punitive, or special damages, including loss of earnings, loss of data, or loss of opportunity, even if WCE has been advised of the possibility of such damages.

20. Indemnification

You agree to defend, indemnify, and hold harmless WCE, its officers, faculty, staff, agents, and partners from any loss, damage, liability, claim, or demand, including reasonable legal costs, arising from: your use of the Platform; your breach of these Terms; your breach of any representations or warranties herein; your violation of any third party’s rights including intellectual property rights; or any harmful act toward another user of the Platform.

21. User Data

WCE maintains data you transmit to the Platform for the purpose of managing platform performance and your learning progress. While WCE performs regular data backups, you are solely responsible for data you transmit or activities you undertake on the Platform. WCE shall have no liability for loss or corruption of such data, and you waive any claim against WCE arising from such loss or corruption.

22. Electronic Communications

Visiting the Platform, sending emails, and completing online forms constitute electronic communications. You consent to receive electronic communications from WCE and agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communication be in writing. You agree to the use of electronic signatures, contracts, orders, and records.

23. Grievance Officer

In accordance with the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020, WCE has designated a Grievance Officer for the Platform:

24. Dispute Resolution

The Parties shall first attempt to resolve any dispute through good-faith informal negotiation for a period of thirty (30) days from the date of written notice of the dispute.

If the dispute is not resolved through informal negotiation, it shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Sangli, Maharashtra. The language of proceedings shall be English. The arbitrator’s decision shall be final and binding.

The following disputes are not subject to arbitration and may be brought directly before the courts: any dispute seeking to enforce or protect intellectual property rights; any claim related to theft, piracy, or unauthorised use; and any claim for injunctive relief.

No arbitration shall be conducted on a class-action basis. Each dispute shall be arbitrated individually.

25. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Subject to the arbitration clause above, the courts at Sangli, Maharashtra shall have exclusive jurisdiction over any matter arising under these Terms.

26. Miscellaneous

These Terms, together with the Refund and Cancellation Policy and the Privacy Policy, constitute the entire agreement between you and WCE regarding use of the Platform. WCE’s failure to enforce any right or provision of these Terms shall not constitute a waiver. If any provision is found to be unlawful or unenforceable, it shall be severed and the remaining provisions shall continue in full force. WCE may assign its rights and obligations under these Terms at any time. There is no joint venture, partnership, employment, or agency relationship created between you and WCE by these Terms.
